These Terms of Service (“Terms”) govern your access to and use of the Wesy mobile application and related services (collectively, the “Services”).


By accessing, downloading, creating an account for, or using the Services, you agree to these Terms. If you do not agree to these Terms, you must not use the Services.

As part of onboarding, Wesy may ask you to select your age range. Age information may be used to determine eligibility and personalize your experience.

  • Other information you provide is accurate to the best of your knowledge.

  • You will comply with these Terms and applicable laws.


Users under 13 are not permitted to use the Services.


If we learn that a user is under 13, we may restrict or terminate access to the Services and take reasonable steps to delete personal information associated with that user in accordance with our Privacy Policy.


If you are under the age of legal majority where you live, you should use the Services with the involvement of a parent or legal guardian where required by applicable law.

Wesy is a weather-powered fashion and outfit recommendation service.


Depending on availability, the Services may include:

Where available, you may choose a city manually instead of granting device-location access.

Disabling location access may affect automatic local-weather features, but other functionality may remain available where supported.

Weather forecasts are inherently uncertain, and actual weather conditions may differ from forecasts.


Wesy does not guarantee the accuracy, completeness, availability, reliability, or timeliness of weather information.


Wesy’s weather information and outfit recommendations are intended for general informational purposes and everyday planning.


You should not rely solely on Wesy for:


  • Severe-weather decisions

  • Emergency decisions

  • Health or safety decisions

  • Travel-safety decisions

  • Other situations where inaccurate weather information could create significant risk


Where appropriate, consult official weather agencies, emergency authorities, or other authoritative sources.

6. Notifications


Wesy may offer optional notifications such as:


  • Daily outfit recommendations

  • Weather-related recommendations

Wesy will request device permission before sending push notifications where required.


You may decline notification permission or disable notifications at any time through your device settings.


Providing a preferred notification or wake-up time does not guarantee that a notification will always be delivered at exactly that time.


Notification delivery may depend on device settings, operating-system behavior, connectivity, and other technical factors outside Wesy’s control.

You are responsible for maintaining the security of your account and login credentials.

You should notify us if you believe your account has been compromised.

You retain ownership of content you provide.


By providing content to Wesy, you grant Wesy a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, analyze, and display that content solely as reasonably necessary to operate, maintain, secure, improve, and provide the Services.


You represent that you own the content you upload or otherwise have all rights and permissions necessary to provide it to Wesy.


You may not upload content that:


  • Violates applicable law

  • Infringes intellectual-property rights

  • Violates privacy or publicity rights

  • You do not have permission to use

  • Contains malicious software

  • Is intended to deceive, exploit, harass, or harm another person

9. Face AI and Reference Images


Wesy may provide AI-powered features that allow you to generate personalized fashion imagery using your appearance.


You may choose to upload a face photo or other reference image.


Wesy may store a selected reference image with your account so that you can continue generating personalized fashion imagery using the same appearance without uploading the image each time.


Where supported, you may replace or delete your reference image.


You are responsible for ensuring that you have the right and permission to upload and use any image you provide.


You may not use Wesy’s AI or image features to:


  • Impersonate another person

  • Misrepresent another person’s identity

  • Deceive or defraud others

  • Harass, exploit, or harm another person

  • Violate another person’s privacy or publicity rights

  • Generate or distribute unlawful content


Wesy’s handling of reference images and facial information is further described in the Wesy Privacy Policy.

10. Artificial Intelligence


Wesy may use artificial intelligence, machine learning, computer vision, algorithms, and automated systems to provide its Services.


These technologies may generate or assist with:


  • Outfit recommendations

  • Shopping recommendations

  • Personalized content


AI-generated content may contain inaccuracies, errors, unexpected results, or visual artifacts.


AI-generated images may not perfectly represent your actual appearance, body, clothing, product appearance, fit, or real-world results.


Wesy does not guarantee that AI-generated content or recommendations will:


  • Accurately represent you

  • Match your preferences

  • Accurately represent a particular product

  • Provide accurate sizing or fit

  • Be free from errors

  • Be appropriate for every situation


You should use your own judgment when relying on AI-generated content and recommendations.

Wesy may display or recommend clothing, accessories, products, brands, retailers, or other merchandise.

Wesy does not guarantee:

Any purchase decision is your responsibility.


Unless expressly stated otherwise, purchases made through third-party retailers are transactions between you and the applicable retailer.

Pricing, billing frequency, included features, renewal terms, and other applicable purchase information will be presented before purchase.


If you purchase a subscription through the Apple App Store, Google Play, or another third-party platform, payment, billing, cancellation, and refund administration may also be subject to that platform’s applicable terms and policies.


Subscriptions may automatically renew unless canceled before the applicable renewal date.


You may manage or cancel applicable subscriptions through the platform or payment provider through which the subscription was purchased.

Wesy may restrict or terminate access for violations of these Terms.

Except for user content and third-party materials, the Services and their associated:

  • User interfaces

  • Graphics

are owned by Wesy or its licensors and are protected by applicable intellectual-property laws.


These Terms do not transfer ownership of Wesy’s intellectual property to you.


Except as permitted by applicable law or expressly authorized by Wesy, you may not reproduce, distribute, modify, sell, license, or commercially exploit Wesy’s intellectual property.

WESY DISCLAIMS WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.


WESY DOES NOT GUARANTEE THAT:


  • THE SERVICES WILL ALWAYS BE AVAILABLE

  • THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE

  • AI-GENERATED RESULTS WILL BE ACCURATE

  • RECOMMENDATIONS WILL MEET YOUR EXPECTATIONS

  • WEATHER INFORMATION WILL BE ACCURATE

  • PRODUCT INFORMATION WILL BE ACCURATE

  • NOTIFICATIONS WILL ALWAYS BE DELIVERED

  • DEFECTS WILL ALWAYS BE CORRECTED


Nothing in these Terms excludes warranties, protections, or rights that cannot legally be excluded.

24. Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WESY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES.


This includes, where permitted by applicable law, losses resulting from:


  • Loss of data

  • Loss of profits

  • Loss of business opportunities

  • Reliance on weather information

  • Reliance on AI-generated content

  • Reliance on outfit or styling recommendations

  • Failure or delay of notifications

  • Shopping or purchase decisions

  • Third-party products or services


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WESY’S TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:


(A) USD $100; OR


(B) THE AMOUNT YOU PAID DIRECTLY TO WESY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.


Some jurisdictions do not allow certain exclusions or limitations of liability, so some of these limitations may not apply to you.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Wesy and its personnel, contractors, licensors, service providers, and partners from claims, liabilities, damages, losses, and reasonable expenses arising from:
